Corvex (“Corvex”, “Company”, “we”, “us” or other similar terms) is an AI cloud computing company specializing in GPU-accelerated infrastructure for AI workloads and other AI-related services (the “Services”).
This Website Privacy Policy (this “Privacy Policy”) describes the privacy practices Corvex uses in connection with Corvex’s website and marketing activities and related interactions as described below. Among other things, this Privacy Policy includes a “Notice of Collection” attached hereto as Exhibit A consistent with the requirements of California privacy law in order to provide information regarding the categories of personal information that Corvex collects from the individuals that visit our website, receive Corvex marketing and otherwise interact with us as described herein, and how Corvex uses that information.
This Privacy Policy does NOT apply in situations where Corvex is processing personal information on behalf of the customers to whom Corvex provides its Services (each, a “Customer”) (or the employees, representatives or other end users of a Customer). Please visit your Corvex Terms of Service or other commercial agreement with Corvex covering the Services for more information related to how we collect and process personal information collected from Customers in connection with the Services.

This Privacy Policy informs you how Corvex collects, uses, secures and shares Personal Information that we collect when you interact with us in the following ways (collectively referred to as “Interactions” including similar terms like “Interacting”, etc.):
For purposes of this Privacy Policy, the term “Personal Information” means data and/or information that identifies, relates to, describes or can be associated with an individual or their household, which may include but is not limited to, name, address, telephone number, e-mail address, online contact information (including, without limitation, an instant messaging user identifier or a screen name that reveals an individual’s e-mail address), account numbers (financial and otherwise), government-issued identifier (including, but not limited to, social security number) and any other data or information considered “personal information” or “personal data” under applicable laws (including, in some jurisdictions, IP addresses, and where applicable cookie information and mobile identifiers).
As noted above, this Privacy Policy relates only to Personal Information we collect in connection with the Interactions and does not address the privacy practices we employ in connection with the Services. Please visit your Corvex Terms of Service or other commercial agreement with Corvex covering the Services for more information related to how we handle information collected via the Services, including if you are the client, buyer or other end user of a Customer. In that situation, the Customer acts as the “data controller” with respect to your Personal Information and any questions or concerns you have about the use of your Personal Information by the Customer must be submitted directly to them as they (and not Corvex) determine the purpose and means for processing your Personal Information. For the avoidance of doubt, Corvex acts as the “data processor” in this situation and is not responsible for, and you will not hold or seek to hold Corvex liable for, any data processing activities undertaken by the Customers.
For clarity, if you Interact directly with us in a capacity other than as a client, buyer or other user of a Customer, your Personal Information will be used by us pursuant to the terms of this Privacy Policy, even if you may also access and use the Services.
When you visit the Site or otherwise Interact with us, we may ask you to provide information, including Personal Information, to support your request or otherwise facilitate the Interaction. You may also voluntarily elect to provide us with Personal Information without our prior request. For instance, you may share Personal Information such as first and last name, organization name, professional title, physical address, email address, telephone number, and social media identifiers with Corvex when you (i) submit web forms (for example, requesting information about our Services or subscribing to Corvex marketing communications) or send Corvex an email or message; (ii) transmit information by telephone, email, or social media networks, including Corvex’s “contact us” web form and/or submitting posts and messages through Corvex’s LinkedIn page or other Corvex social media sites; (iii) register for or attend a Corvex event; or (iv) provide it via other methods that Corvex may request, allow or enable from time to time (for instance, responding to surveys; participating in marketing activities, or providing suggestions or improvements for the Interactions).
When you access and use the Site or otherwise Interact with us, we may use technology to automatically collect information, including Personal Information, about you, your device and/or our Interaction. For example:

Based on this, the platform may show you our ads, look for other users who may enjoy our ads, suppress our ads for you, and provide us insights on how to optimize and better target our advertising.
We will process your Personal Information given our legitimate interest in undertaking marketing activities to offer you products or services that may be of your interest, informing our marketing strategies, and developing and growing our business.

If we receive your Personal Information from a data controller for whom we act as a processor and you wish to exercise your rights under applicable law, then we will forward your request to the data controller of your Personal Information to allow them to respond.
We will only retain your Personal Information for as long as is necessary to carry out the purpose for which it was collected, and if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements. If you no longer want us to use your information for purposes of carrying out the Interactions, you can request that we erase your Personal Information. However, please note that we may no longer be able to support or provide the facilitate the Interactions in that situation. Please also be aware that because we maintain our networks to protect from accidental or malicious loss and destruction, residual copies of your Personal Information may not be removed from our backup systems for a limited period of time.
We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. We are SOC2 certified and all information you provide to us is stored on our secure servers. Unfortunately, no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, while we strive to protect your Personal Information, we cannot guarantee its absolute security.
Corvex will use reasonable efforts to notify you of any data breach or security incident impacting your Personal Information in any material respect. To the extent permitted by applicable law, we expressly exclude any liability arising from any unauthorized access to Personal Information.

The Interactions are not intended for or targeted at children, and we do not knowingly collect Personal Information from children. If we learn we have collected or received Personal Information from an individual under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child, please contact us at privacy@corvex.ai or by using the contact information set forth below.
If you are a resident of certain states (e.g., California, Colorado, Connecticut, Utah or Virginia), you have certain additional privacy rights expressly granted by the privacy laws adopted by your jurisdiction. Please see Exhibit A to this Privacy Policy for a notice of the additional privacy rights that may be available to you depending on your applicable jurisdiction. If you are a resident of California, please note that Exhibit A includes our “Notice at Collection” as required by California law.
Corvex is located in the United States of America. Therefore, any Personal Information we collect will be transferred to, stored, and processed in the United States, which may not be regarded as providing the same level of protection for Personal Information as the laws of your home country. By providing Personal Information to Corvex, you consent to the transfer to, and processing in, the United States as indicated herein.
Corvex may from time to time use certain Sub-Processors in connection with providing the Site and facilitating the Interactions. Your Personal Information may be provided to and used by such third parties. See our Sub-processor List at the end of this Privacy Policy for more information regarding the specific Sub-processors we use. To the extent possible, we seek to limit the rights of these parties with respect to your Personal Information where reasonable, and we do not grant any rights to these organizations to use this information for any marketing or other purpose beyond providing services to us in connection with our business activities; provided that these limitations do not apply to our third party business partners that we may provide information to for marketing or commercial purposes as described above.
This Privacy Policy only addresses the use and disclosure of Personal Information Corvex collects in connection with the Interactions. Other sites, including sites that may be linked to or available via the Site (if any), have their own privacy policies and data collection use and disclosure practices. Please consult each third party site's privacy policy to understand the privacy practices employed by those third parties. Corvex is not responsible for the policies or practices of unaffiliated third parties that are not our Sub-processors.
We may update our Privacy Policy from time to time. Modifications will be effective as of the date stated by the “Last Updated” line at the top of this Privacy Policy, or such other date as communicated in a notice to you (which notice which may be given by means including, but not limited to posting the revised Privacy Policy on the Site).
You acknowledge and agree that it is your responsibility to review the Site and this Privacy Policy periodically and to be aware of any modifications. Your continued Interactions with us after such modifications will constitute your (i) acknowledgment of the modified Privacy Policy; and (ii) agreement to abide and be bound by the modified Privacy Policy.
Subject to any requirements or restrictions imposed by applicable law, Corvex’s total and aggregate liability (whether on a direct or indirect basis) arising from or related to this Privacy Policy is one hundred dollars or any amounts set forth in a customer agreement entered into between you and us.

United States Privacy Notice; Notice at Collection

This Exhibit contains additional information relevant to residents of certain US states that have their own laws and regulations regarding data privacy, including the rights that may be available to residents of those states. This United States Privacy Notice should be read in conjunction with the Corvex Website Privacy Policy set forth above, which provides a description of all of our data collection, use and disclosure practices with respect to the Interactions. Capitalized terms used in this United States Privacy Notice that are not defined herein have the applicable meanings provided in the Privacy Policy. If any terms in this United States Privacy Notice conflict with other terms contained in the Privacy Policy, the terms in this United States Privacy Notice shall apply on a case-by-case basis with respect to personal information from a jurisdiction covered in this United States Privacy Notice (and only with respect to the particular jurisdiction giving rise to the conflict, and not with respect to personal information covered by other jurisdictions that is not in conflict.) The term “Personal Information” as used herein shall mean the data or information that is considered “personal data” or “personal information” (or similar terms) under corresponding state privacy law.

Stat. §§ 6-1-1301 to 6-1-1313) (“ColoPA”); (iii) residents of Connecticut are subject to additional rights granted by the Connecticut Data Privacy Act (Public Act No. 22-15) (“CTDPA”); (iv) residents of Utah are subject to additional rights granted by the Utah Consumer Privacy Act (Utah Code Ann. §§ 13-61-101 to 13-61-404) (“UCPA”); and (v) residents of Virginia are subject to additional rights granted by the Virginia Consumer Data Protection Act (Virginia Code Ann. §§ 59.1-575 to 59.1-585) (“VCDPA”). Additionally, new state privacy laws may come into effect from time to time. To the extent reasonably possible, this Exhibit shall be construed as covering and applying to all such laws and the terms and conditions of this Exhibit shall be deemed to be updated and adjusted on a mutatis mutandis basis as reasonably necessary to account for those new state privacy laws. Without limiting the effect of the foregoing, we may also physically update this Exhibit from time to time as necessary to comply with the requirements of any state privacy laws, and those updates will take effect upon the updated Exhibit being posted with an updated revision date.

Please specify the particular right you want to exercise in your request. Please note that altering, updating or deleting any Personal Information may alter the functioning or operation of some or all of the Site or other Interactions we provide.
We will respond to your request within the timelines required by the laws of your jurisdiction. In order to protect your Personal Information from unauthorized access or deletion, we may require you to verify your identity before you can submit a rights request. If you do not have an account with us, or if we suspect that your account has been compromised, we may ask you to provide additional Personal Information for verification. If we are subsequently unable to confirm your identity, we may refuse your rights request.
In addition, there may be information we will not return in response to your request, such as information that could affect the privacy of others or violate legal requirements. Likewise, there may be reasons why we cannot comply with your deletion request, such as our need to keep your Personal Information to comply with a legal obligation. In addition to the rights granted above, California Civil Code Section 1798.83 (the “Shine the Light Law”) permits individuals that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Please contact us at privacy@corvex.ai if you are a California resident and would like to exercise your rights under the Shine the Light Law.
We may retain and use your Personal Information as necessary to facilitate the Interactions, comply with our legal obligations, or resolve disputes. Consistent with these requirements, we will delete your Personal Information within the time limits imposed by applicable law, if any. A more detailed description of our data retention practices is in our Privacy Policy under the Section entitled “Data Retention”.
We may sometimes de-identify your information. Where we maintain or use de-identified data, we will continue to maintain and use the de-identified data only in a de-identified fashion and will not attempt to re-identify the data. Please know that de-identified data is not subject to the same requirements as set forth in this Notice with respect to Personal Information generally, but we will at all times comply with laws applicable to de-identified data.
